Terms and conditions

These terms and conditions of sale (hereinafter referred to as ” Terms “) provide for the general terms and conditions of the purchase and sale agreement to be concluded when making purchases in the online store located at www.ingamo.eu (hereinafter referred to as ” Online Store”).

The operator of the online store is Ingamo LLC with registration code 14705299 (hereinafter ” Ingamo “).

  1. AGREEMENT
    1. These Terms regulate the legal relations between Ingamo and the person who made a purchase in the Online Store (you) when buying and selling products offered in the Online Store.
    2. The display of products in the Online Store is not a legally binding offer, but a non-binding online catalog of products. When completing the purchase, you submit a binding purchase order for the products in the shopping cart. Immediately after placing an order, you will be sent a confirmation of receipt of the order, but this is not an acceptance to enter into a contract. Ingamo may accept your order within three days by sending you an order confirmation by e-mail or by sending you the goods. If you accept the order, a purchase and sale agreement is considered to be concluded between you and Ingamo under the conditions specified in the order and these Terms.
    3. Product selection, prices and discounts may differ from the selection, prices and discounts of Ingamo products offered in Ingamo retail stores or third party retail stores.
  2. PRICE
    1. The prices valid at the time of placing the order are applied to the purchase order. Prices are in euros and include VAT.
    2. The delivery fee corresponding to the delivery method you selected when placing the purchase order is added to the price of the products. The delivery method is selected and the delivery fee is calculated in the shopping cart.
    3. Ingamo has the right to partially or completely withdraw from the contract concluded in the Online Store and not to send the ordered products if the price or quality of the products was displayed incorrectly on the website or the final price of the shopping cart was displayed incorrectly due to a system error. If we find an error, we will notify you immediately and refund the purchase price to you immediately using the same payment method you used to pay. In the event of withdrawal on this basis, you are not entitled to claim compensation for any loss that may arise from the withdrawal.
  3. ORDER and PAYMENT
    1. To order products, select the size of the product on the product page, if necessary, and add the product to the cart using the ” Add to cart ” button.
    2. Until you pay for the products, you can change the quantity of products in the shopping cart and remove products from the shopping cart.
    3. To complete the purchase order, enter the requested information in the shopping cart, select the payment method and press the ” Checkout ” button.
    4. A binding purchase order has been submitted after pressing the ” Place Order ” button and completing the payment.
    5. NB! When using a bank link payment confirm the order and then click on the ‘Return to merchant’ button.
    6. Immediately after placing the order, you will be sent a confirmation of receipt of the order by e-mail, and within three working days, as expected, an order confirmation, also by e-mail. If you do not find the order confirmation in your inbox, please check that the email has not accidentally ended up in the spam folder.
    7. Payment for the products is made in full in advance.
    8. You can pay internationally for the products by credit card (Visa, MasterCard ) by PayPal.
    9. You can pay internationally for the products by credit card (Visa, MasterCard ) by Montonio Finance UAB. 
    10. You can pay for the products by bank links in Finland (Nordea, Danske Bank, OP, Handelsbanken, S-Pankki, Oma Säästöpankki, POP Pankki, Säästopankki, Ålandsbanken), Baltic States(Swedbank, SEB, Luminor, LHV, Coop Pank, Citadele, Šiaulių Bankas, Medicinos Bankas), Poland (AliorBank, Pekao, BNP Paribas, Bank Polski, Credit Agricole, ING Bank, Inteligo Bank, mBank, Millenium Bank, Santander).
    11. Alternative payment methods: Revolut – available everywhere
    12. Payment is made always in a secure electronic payments environment outside the Online Store created by the bank or the payment processor. Ingamo does not have access to your bank and credit card information.
    13. The personal data necessary for the execution of payments is processed and transferred to authorized processor PayPal (Europe) S.à r.l. et Cie, S.C.A. (“PayPal”) or provided by Montonio Finance UAB registered in the Republic of Lithuania, registry code 3050205122, address Konstitucijos pr. 7, Vilnius, Lithuania. Ingamo never has access to your bank and credit card information.
  4. DELIVERY
    1. The e-store delivers products to all the European Union Member States and to selected countries internationally.
    2. Products will be delivered to the customer by Registered Maxi Letter Business Letter and Omniva Parcel to the automated parcel terminal provided by Omniva and Services provided by Itella SmartPOST OÜ, as well as the DPD pickup point and the DPD courier. Shipments can be tracked at Omniva (formerly Estonian Post) and in the international monitoring environment of the UPU at www.track-trace.com/post. Itella SmartPOST tracking environment at new.smartpost.ee/shipping-otsing. DPD Eesti AS shipments can be tracked in the DPD tracking environment: https://www.dpd.com/ee_eraklient. In addition, Click&Collect is one option for delivering products to selected Baltika stores.
    3. The goods are delivered to the European Union Member States by Omniva  https://www.omniva.ee/ EMS – the Express Mail Service, Registered Maxi Business Letter or Omniva automated parcel terminal service. Shipments can be tracked on the Omniva tracking web page https://minu.omniva.ee/track or for the international shipments https://www.track-trace.com/post.
    4. The goods can be also delivered to the European Union Member States by Itella SmartPOST. Shipments can be tracked in the international monitoring environment of the UPU at www.track-trace.com/post. Itella SmartPOST tracking environment at new.smartpost.ee/shipping-otsing.
    5. All orders with the Standard Shipping method are with Free Delivery within European Union. 
    6. Ingamo hands over the goods to the logistics company for delivery no later than five working days after order confirmation and on average, the goods will reach will you by courier within 8–14 days in European Union, but the times differ per countries.
    7. In exceptional cases Ingamo has a right to ship the goods in up to 45 calendar days from the date of the purchase.  
  5. RIGHT OF WITHDRAWAL, RETURN AND EXCHANGE OF PRODUCTS
    1. Ingamo has the right to withdraw from the purchase and sale contract and ask to return the goods/ products you bought and/or sent to you, if the price of the product was marked significantly lower than the actual price of the product in the Online Store due to a technical or human error.
    2. Ingamo has the right to withdraw from the purchase and sale contract or not to deliver the ordered product if the product is out of stock or the product’s availability is displayed in the Online Store due to a technical or human error. In this case, Ingamo will partially or completely cancel your order and inform you immediately. In case of a partial cancellation, Ingamo may ask your preference for handling the rest of the order – whether to confirm (and ship) it or cancel it as well.
    3. You have the right to withdraw from the sales contract within 14 days. In order to exercise the right of withdrawal, please send us a clearly understandable statement of intent to withdraw from the purchase and sale contract by e-mail (to the address customer@ingamo.eu. In the withdrawal statement, please provide the following information: customer name, e-mail address, telephone number, address, order number, product code and name of the product to be returned, date of order, date of receipt of the product and reason for return.
    4. Ingamo will confirm receipt of the withdrawal request by sending you a corresponding notification by e-mail.
    5. In case of withdrawal from the contract, we will return all payments received from you, except shipping costs, as soon as possible and in any case no later than 14 days from the day we received the products you are returning. We will use the same payment method that you originally used to pay for the refund. We may hold your refund until we have received the products back.
    6. In the event of product exchange or replacement, you shall bear all direct costs associated with returning the product, unless you have received a defective product, in which case Ingamo shall bear the direct costs associated with the return.
    7. In case of withdrawal from the contract, you undertake to return the goods or hand them over to us or our carrier as soon as possible and in any case no later than within 14 days from the day on which you notified the withdrawal from the contract.
    8. According to § 53 (4) clauses 2, 3 and 4¹ of the Law of Obligations Act, the right of withdrawal does not apply to such contracts, the subject of which is a product that was not ready before and was manufactured taking into account the personal needs of the consumer or according to the conditions provided by the consumer, and the right of withdrawal ends prematurely if the goods are handed over in a sealed package , which is not eligible for return for health or hygiene reasons (e.g. underwear and sunwear) and the package has been opened after delivery. Therefore, it is not possible to withdraw from the contract and return the product if it is made to special measurements.
    9. If the size of the ordered product did not suit you, you can exchange the product for a different size within 14 days of receiving it.
    10. Until the exchange or return product is received, Ingamo is not responsible for possible damage to the products, therefore we recommend that you keep the document that you receive when you post it for later proof of posting, and we ask that you choose registered post as the method of delivery if possible.
  6. COMPLIANCE OF THE GOODS WITH THE CONTRACT TERMS
    1. If there are defects in the products you receive, you have the right to use the legal remedies provided for in the case of non-conformity of the contract.
    2. Ingamo is not responsible for defects that have occurred after the goods have been handed over to the buyer. If the goods purchased from the Online Store have defects for which Ingamo is responsible, Ingamo will repair or replace the defective goods. If it is not possible to repair or replace the products, Ingamo will return all fees associated with the sales contract to the buyer.
    3. Ingamo will not reimburse you for or be liable for product non-conformity or defects if:
      1. The value of the product has decreased/the product has been damaged due to your fault;
      2. Defects have arisen as a result of non-intended use of the product, including failure to follow the maintenance instructions;
      3. The value of the product has decreased due to natural wear and tear from normal use;
      4. There is no copy of the proof of purchase.
    4. If a defect occurs, you have the right to contact Ingamo with a complaint within two months at the latest by sending an e-mail to the address customer@ingamo.eu , indicating your name and contact information, the date of the complaint, the defect in the product and your preferred solution. Ingamo will respond to your complaint in writing or in a form capable of being reproduced in writing within 15 days.
    5. If you do not reach an agreement with Ingamo regarding the complaint, you have the right to turn to the Consumer Disputes Committee operating at the Consumer Protection Board in Estonia for an out-of-court settlement of the dispute. The Consumer Disputes Commission is competent to resolve disputes arising from the contract concluded between you and Ingamo. Review of your complaint by the commission is free of charge. The laws of the Republic of Estonia are used to resolve disputes in Estonia at the Consumer Protection Board. You can also contact the European Union consumer dispute resolution platform: https://ec.europa.eu/consumers/odr/main/index.cfm . In case of disagreement with the commission’s decision, the parties have the right to appeal to the court.
  7. FINAL PROVISIONS
    1. The law of the Republic of Estonia applies to these Terms.
    2. Ingamo has the right to unilaterally change these Terms and the prices of the products and services offered in the Online Store. Ingamo informs about changes in the online environment of the Webshop.
